This privacy statement explains the user of the website www.molinari-rail.com about the nature, scope and purpose of the collection and use of personal data by the responsible Molinari Rail AG (hereinafter «operator»).

Presentation of the Website

The operators store the following data each time they access this website: name of the website visited, requested file, date / time, amount of data transmitted, message about successful retrieval, browser type / version, operating system, previously visited page and IP address.

Purpose of processing:
Molinari Rail AG and Molinari Rail GmbH (hereinafter “Molinari”) will process your personal data for the following purposes:

  • to establish, administer and conduct the business relationship including the organization and any claims management;
  • to assess qualification in staffing processes;
  • to inform the potential employer

As far as Molinari collects your personal data from you, the provision of your personal data is always voluntary. However, if you do not provide your personal information, Molinari may not or may not fully comply with the contract.

Legal bases of processing for applicants:
If you are an applicant, Molinari processes your personal data because this is necessary to fulfill the contract concluded with your potential service or client (art.6(1) (b) GDPR). In addition, Molinari processes your personal data on the basis of the predominant legitimate interest to achieve the purposes mentioned under (a) (art. 6 (1) (f) of the GDPR) and on the basis of various legal bases, such as: the BAO (art. 9 para 2 lit. G DSGVO) or for the assertation and/or defense of legal claims (art.9 (2) (f) GDPR).

Molinari will process your contact data for the purpose of direct mail or telephone contact only with your express consent in accordance with Art. 6 (1) or 9(2)(a) of the General Data Protection (“DSGVO”).

If you have already provided the contact details to Molinari before 25.05.2018, e.g. by handing over a business card, we process it for further contact- in particular for marketing purposes for own purposes and for sending offers and information about the services of Molinari by post or by e-mail including the invitations to events – on the basis of our predominant authorized interest (Art. 6 (1) (f) GDPR).

Molinari stores the data categories accordingly:

  • Photo (if published on the internet or provided)

Your personal data, which is required for the tender procedure and which you provide voluntarily, such as:

Newsletter

If a user subscribes to the newsletter of the operator, personal data of the user, salutation, first and last name, and the e-mail address are collected and processed. The user then receives up to four times a year a personalized e-mail with information and offers of the operator (newsletter) tailored to his needs.

By subscribing to the newsletter, the user, in accordance with Article 6 (1) (a) of the GDPR, gives his conclusive consent that his data may be used for the regular sending of the newsletter.

After the registration, the user will receive a confirmation and authorization e-mail on the e-mail address provided by him with the request to click on the link contained therein. This ensures that only the authorized user of the given e-mail address can sign up for the newsletter.

The user can unsubscribe from the newsletter at any time. At the end of each newsletter, there is a link that allows the user to unsubscribe. Alternatively, the user can also send a corresponding e-mail to info@molinari-rail.com. After unsubscribing the newsletter, the user’s personal data will be deleted from the newsletter mailing list within one month.
